THE ADIPOSITY CLINIC is for non-emergency medical weight loss. If you are experiencing a MEDICAL EMERGENCY, CALL 911 or your medical provider.

Welcome to The Adiposity Clinic’s telehealth weight loss program. These Terms of Service (the “Terms”) apply to your use of any of THE ADIPOSITY CLINIC Services for which you are a patient or have a consultation scheduled and are further described below:

 Please carefully review these terms of service before using our services.

 This document provides an explanation of the terms, policies, and more that are applicable to your use of TAO COSMETIC pllc DBA THE ADIPOSITY CLINIC websites, products, or services (“WE”, “THE ADIPOSITY CLINIC” “SITES” or “PROGRAM”. It includes details on how we handle your (“YOU”, “YOUR” or “PATIENT”) personal information and how you can update and manage that information.

Prior to using the Sites or Services, it is important to carefully read and understand these Terms. By visiting or using any of the Sites or Services, you are acknowledging and accepting the practices and provisions outlined in these Terms, as well as our Practice Policy, Notice of Practices Policy, and other referenced documents such as terms, agreements, statements of rights, consent forms, and policies.

 If you do not agree to these Terms or any of the referenced documents mentioned above, we kindly request that you refrain from using our Sites or Services.

This Terms of Service agreement includes a mandatory arbitration provision, unless you opt-out of arbitration in a timely manner as per the terms. You consent to resolving disputes through binding, individual arbitration between you and us, or you and the medical groups or providers, related to the terms and conditions or the service. Additionally, you waive your rights to a jury trial and participating in class action lawsuits or class-wide arbitration where permitted by law.

OUR RELATIONSHIP WITH YOU:

1.     Telehealth: The Adiposity Clinic provides remote weight loss healthcare services through telecommunication technologies via a HIPPA secure portal. This includes consultations, compounded GLP-1 Agonist medication, monitoring, and support for weight management. The Adiposity Clinic respects the clinician’s expertise and does not interfere with their judgment or treatment recommendations for weight loss medication. To ensure patient safety in the at-home self-administered medication program, the Adiposity Clinic has specific criteria for patient selection and uses specific compounding pharmacies that deliver medication to your door. After reviewing your information, the medical provider will use their professional judgment to decide whether to prescribe compounded GLP-1 Agonist medication, suggest other treatments, or advise you to seek alternative clinical resources. If you do not want compounded medication, or want GLP-1 Agonists shipped to your pharmacy for pick up do not use our weight loss program as we do not currently offer those options.

2.     Initial Consult: Your initial consultation will involve a thorough assessment of your medical history, current health status, medications, and weight loss goals. Initial consult fee is for the initial visit with the clinician, either Dr. Dragotti DO or one of his Nurse Practitioners. This visit does not guarantee eligibility for prescription of compounded GLP-1 Agonists. This initial consult visit cost does not include price of medication or subsequent monitoring.

Eligibility and suitability for THE ADIPOSE CLINIC PROGRAM is based off response to initial website eligibility criteria, submitted blood work Comprehensive Metabolic Panel (CMP) obtained within last year, Photo Identification, and review of Medical history by THE ADIPOSITY CLINIC clinician at the time of the initial consult. If you meet are requirements as deemed by your ADIPOSITY CLINICIAN ( see section 8 below) then you will qualify for the program. It is important to answer any questions or fill out documents truthfully for your safety.

Initial consult fee is a one-time charge for the physician’s time and evaluation. This will be collected regardless if you qualify for medication or not. There are two Programs: Name Brand Medication Zepbound (Tirzepatide) Monitoring program and Compounded Medication Monitoring Program ( either compounded Tirzepatide/B12 or Semaglutide with/without B12).The intial consult fee is also considered the Clinician fee for the first consecutive 90 days while on the medication. A new Physician fee of $149 will incur every 90 days while on the medication. If you stop being an active medication monitored patient for 60 days or more, then a new consult and associated fee will be charged, and you will need to update consents and related documents. You may be required to submit new blood work (CMP) as well. Blood work is NOT included as part of the program or monitoring cost and may be out of pocket if not covered by your insurance. THE ADIPOSITY ClINIC does not accept Insurance or provide/ fill out insurance related forms at this time.

3.     Medical Monitoring and Medication: If you meet above criteria for an at home weight loss program, after the initial visit you will be able to purchase medication. Medication is sent from either Lilly Direct Pharmacy for Zepbound, or for compounded medications like Tirzepatide/b12 & Semaglutide, USA located compounding pharmacies; Accredited by the Pharmacy Compounding Accreditation Board (PCAB) for compliance, a service provided by the Accreditation Commission for Health Care (ACHC) who have met our quality, sterility and safe shipping standards for their weight loss medications,. Monitoring services are provided while taking an Adiposity Clinic prescribed compounded medication for the duration of your prescribed treatment length by the clinician and nursing team as described for visit charges above under 2. Initial Consult section. Typical Clinician visits are 4 to 8 per year and video conference length is usually less than 15 minutes. Clinicians typically only do video conferencing calls through a secure HIPPA compliant video link supplied by the EMR portal. Patients needing additional clinician visits beyond 12 per year will be charged $100/ 15 minute clinician visit depending on duration of treatment. If a requested amount of clinician visits is deemed excessive, it may be determined you are having difficulty with an at home self-injection or oral medication program. All efforts will be used to assist you in your difficulties, however, if clinician feels that you are not a good fit for the program they will discharge you from the program  and recommend you seek advice from your Primary Care Physician who may have other options for medication. Nursing visits and interactions vary in length, and number per treatment cycle and may be via email, phone, or telehealth video conferencing.

You will be required to have repeat blood work when continuation of the program is selected by you. Blood work is NOT included as part of the program or monitoring cost and may be out of pocket if not covered by you insurance. THE ADIPOSITY ClINIC does not accept Insurance or provide/ fill out insurance related forms at this time.

 Blood work consists of at minimum a CMP (Comprehensive Metabolic Panel) after 6 weeks of treatment, then 3 months following the first repeat lab work and then at 6 months following the previous blood draw. For longer treatment yearly blood work will be required. It is at the discretion of the clinician to order additional blood work if warranted.

4.     Clinicians and Medical Staff: Services are provided by directly employed licensed healthcare professionals and trained support staff licensed to practice in your state. We do not use third party contracted clinicians at this time. The Adiposity Clinic respects the clinician’s expertise and does not interfere with their judgment or treatment recommendations for weight loss medication or symptomatic relief medication. To ensure patient safety in the at-home self-administered medication program, the Adiposity Clinic has specific criteria for patient selection. After reviewing your information, the medical provider will use their professional judgment to decide whether to prescribe medication, suggest other treatments, or advise you to seek alternative clinical resources.

Medical Staff includes Nurses who are available to assist you with issues that may arise or for routine visits. Emails are responded to same day; however, a real time video visit may not always be available same day.

The ADIPOSITY CLINIC does not prescribe NARCOTICS for weight loss associated symptoms. You should not require Narcotics for symptomatic relief from weight loss medication common side effects. If you have abdominal pain or feel you require Narcotic Pain Medication, this may indicate a severe side effect of GLP-1 Agonists or a coincidental medical issue unrelated to the GLP-1 Agonists and should seek Medical treatment by calling 911, notifying your Primary Care Clinician for further instruction or going to your nearest hospital for further management.

5.     Pharmacy Services: THE ADIPOSITY CLINIC is NOT a pharmacy. We currently only use Lilly Direct Pharmacy for Zepbound ( Tirzepatide) or certain compounding pharmacies for our compounded Tirzepatide/ B12 & Semaglutide medications which ship directly to your address of choice.  All other medications may be sent to any pharmacy you regularly use and may be out of pocket expenses if not covered by your insurance.​

Compounded GLP-1 Agonist Medication fulfillment, if prescribed, is provided from USA located compounding pharmacies; Accredited by the Pharmacy Compounding Accreditation Board (PCAB) for compliance, a service provided by the Accreditation Commission for Health Care (ACHC) who have met our quality, sterility and safe shipping standards for their weight loss medications, ​licensed to dispense medications to the state jurisdictions served by THE ADIPOSITY CLINIC. You acknowledge that your compounded glp-1 agonist prescription(s) may be filled and transferred between these pharmacies, and you consent to THE ADIPOSITY CLINIC taking these actions on your behalf.

Zepbound (Tirzepatide) self injection vials come directly from Eli Lilly’s Lilly Direct Pharmacy. Alcohol wipes and insulin needles can be purchased through them and will be prescribed if option allows. Shipping charges may apply. Needle disposal canisters, additional alcohol wipes and syringes can be found for purchase online ( examples. Amazon, Walmart)  and at most pharmacies in your area.  We recommend single use 0.5ml 31gauge insulin syringes for most doses. Credit or debit card are options for purchase. They do not accept insurance for the Direct Pay Pharmacy.

Compounded self-injection or oral GLP-1 Agonist Semaglutide comes directly from the Pharmacy with injection syringes and alcohol wipes (when applicable) which should cover duration of treatment. Needle disposal canisters are not included with this program and are recommended. Needle disposal canisters, additional alcohol wipes and syringes can be found for purchase online ( examples. Amazon, Walmart)  and at most pharmacies in your area.  We recommend single use 0.5ml 31gauge insulin syringes for most doses. Credit or debit card are options for purchase

Medication is shipped from the Pharmacy directly with cooling packs to you with associated syringes & alcohol wipes.

Please note medication should be refrigerated upon receiving. Packaging upon arrival may have melted packs. Our associated Compounding Pharmacies have researched stability of compounded GLP-1 Agonist medication and have found medication remains 99% potent for at least 7 days. This is important during summer months with heat waves in certain states. Typical transit times are less than 7 days so medication should be potent even if ice packs appear melted.

While compounded GLP-1 Agonists come from specific compounding pharmacies approved by THE ADIPOSITY CLINIC, GLP-1 Agonist side effects symptomatic relief medication, if needed, can be prescribed and sent to any pharmacy you chose in the states we provide services. Symptomatic medication may not be covered by your insurance and may be an out of pocket expense.

6.     Electronic Communications: By enrolling in and utilizing THE ADIPOSITY CLINIC, you acknowledge and agree to engage in electronic transactions with THE ADIPOSITY CLINIC, including interactions with medical providers and affiliated professional entities. These electronic processes carry the same legal validity as a handwritten signature. You consent to receive disclosures, messages, notices, and other communications from THE ADIPOSITY CLINIC, its affiliates, subsidiaries, and affiliated professional entities at your designated mobile phone number and email address.

You understand and acknowledge that THE ADIPOSITY CLINIC assumes no responsibility for the security or privacy of the communication services you use to receive these messages and emails sent by THE ADIPOSITY CLINIC. It is your sole responsibility to monitor and respond promptly to these communications. Neither THE ADIPOSITY CLINIC nor TAO COSMETICS pllc, nor any provider associated therewith, shall be liable for any loss, injury, or claims arising from your failure to read or respond to these messages, or for failing to comply with any treatment recommendations or instructions from the PROGRAM or your Provider(s).

If you do not agree with any of these terms or our Privacy Policy, you are not authorized to use the Sites or THE ADIPOSITY CLINIC Service.

7.     Termination of Services: The Adiposity Clinic reserves the right to suspend or terminate services with or without notice if a client violates our terms of service or engages in inappropriate behavior. Sections Disclaimer of warranty, Limitation of Liability; Indemnification, Dispute resolution, Arbitration and Class Action Waiver; shall continue to be effective after this agreement is terminated.

Terms of Service will remain in full effect while you are using our services and website. You may discontinue the Terms at any time by terminating use of our PROGRAM, Website and/ or Services. We have the right to amend these terms at any time without penalty from you or third-parties. We recommend checking the terms of Service often for updates. If you do not agree with the terms,  your sole remedy is to discontinue our Portal or websites from  any further use by you.

8.     Eligibility: In order to receive medication if prescribed the following must be true:

A.   -Be ages 18 to 75 yers old

-Have a  BMI of 25 to 45

-Not be pregnant or Breast Feeding.

-Not have Medullary Thyroid Cancer or family history of Medullary Thyroid cancer or MEN 2 Syndromes.

-Not have a history of or current Pancreatitis.

-Not have severe GI Issues, Crohn’s, Ulcerative Colitis or Gastroparesis

-Not have currently treated Diabetes- will work with Physician if allowed

-Kidney failure or on Heart Medications like Coumadin or Digoxin

-On Weight loss medications including GLP-1 Agonists and not willing to Stop

-Have Hypersensitivity To GLP-1 AGONISTS or B12

B.   Provide Normal blood work (CMP) results from within last year. A lab requisition will be provided before medication can be prescribed if you do not already have blood work for the initial visit. Blood work is not part of the PROGRAM and may be an out of pocket expense if not covered by your insurance.

C.  Fill out and submit consent forms and agree to the Practice Policies, Privacy Notice & Terms of service. Upload Photo Identification that has your Name and Date of Birth and submit blood work.

D.  You have access to compatible computing or mobile devices, access to the Internet, and necessary software to utilize the Sites. Fees and charges may be applicable for mobile services and Internet usage charged by your internet or phone providers for use.

E.   It is understood and agreed that meeting these requirements does not ensure receipt of the Services through the Sites. Furthermore, in addition to these prerequisites, THE ADIPOSITY CLINIC and its affiliated professional entities retain the right to modify or introduce new requirements at their discretion, without prior notice to you.

9.   Availability: THE ADIPOSITY CLINIC PROGRAM is subject to state regulations and may change from time to time due to changes in applicable regulatory requirements. THE ADIPOSITY CLINIC PROGRAM is currently available to eligible individuals located Washington, Oregon, New York, New Hampshire.

10.   Registration, User Accounts, and User Data: When registering for THE ADIPOSITY CLINIC PROGRAM, you are required to provide accurate and complete information. Registration procedures are subject to state regulations and may be modified periodically to comply with updated regulatory requirements. THE ADIPOSITY CLINIC PROGRAM is presently accessible to eligible individuals in specific states.

You are responsible for maintaining a true, accurate, and complete email address, physical mailing address, and other relevant information required for the services you seek. It is your obligation to promptly update any changes to this information. Assistance for updates can be found by emailing info@AdiposityClinic.com. Access to THE ADIPOSITY CLINIC PROGRAM is granted exclusively to users who have registered and enrolled through THE Adiposity Clinic Portal at www.AdiposityClinic.com, as well as to affiliated individuals with authorized accounts comprising usernames and passwords. It is your responsibility to protect your user name and password.

Please note that the Sites may become inaccessible at any time and for any duration, and THE ADIPOSITY CLINIC PROGRAM holds no liability if all or part of the Sites are unavailable for any reason.

Upon registering an account, the Sites may include fields for entering and transmitting your user information or data (“User Data”) through them. You acknowledge and agree that any User Data provided by you may be utilized, copied, or displayed by THE ADIPOSITY CLINIC. THE ADIPOSITY CLINIC reserves the right to create derivative works based on such data and to provide it to our service and medical providers, successors, assigns, and affiliated medical/pharmaceutical providers and their professional entities in the course of delivering the Services.

By submitting User Data on or through the Sites, you grant THE ADIPOSITY CLINIC, our service and medical providers, successors, assigns, and affiliated medical/pharmaceutical providers and their professional entities a fully transferable, sublicensable right and license to use, reproduce, modify, analyze, perform, display, distribute, and disclose to third parties any such User Data. This grant is for purposes including providing Services to you, conducting research or analysis of the data, and designing, developing, implementing, modifying, and/or improving current or future features, products, and services of THE ADIPOSITY CLINIC PROGRAM.

11.   Your Protected PHI: Your Protected Health Information (PHI) will be handled in accordance with HIPAA regulations and our Privacy Policy and Notice of Practices Policy. By Using THE ADIPOSITY CLINIC PROGRAM and SITES you consent to the sharing of your HPI in all or part as needed, to perform the requested services with our medical staff and support team, our Third Party Billing service Stripe, Pharmacies utilized or blood laboratories.

Information not considered PHI under applicable law that you submit is not subject to our Privacy policy.

12.   Your Responsibilities and Acknowledgement:

You are responsible for following the personalized recommendations provided by our clinicians and for informing us of any changes in your health status, as well as providing accurate, truthful personal & health information.

You agree not to share your account or password with anyone else.

You are responsible for guarding your password to the site, as well as, safe guarding any mobile or computing devices you may have or use to access the PROGRAM. You agree to change your password immediately if you feel your password may have been compromised.

You agree to notify THE ADIPOSITY CLINIC if there has been a breach of any unauthorized use of your username, password or any associated information that may be used for the PROGRAM. Suspected breach of information notification can be sent to info@AdiposityClinic.com

You are responsible for any payments billed. If you feel that a payment has been made in error, please contact: info@AdiposityClinic.com

13.   Restriction on Use: You agree not to:

 Misuse our services or engage in any unlawful activity, not send malicious, harassing, defamatory, threatening or objectionable material of any kind.

Send:  material that may harm THE ADIPOSITY CLINIC services or computers, Solicitation or unrequested advertising or promotional materials, Spam, to any of our sites or within the PORTAL.

Attempt or engage to attempt to disable, download viruses, capture other user data via any means, reverse engineer or attempt illegal access to our PORTAL or WEBSITES.

14.   License: We grant you a limited, non-exclusive, non-transferable, revocable license to use our services for personal use only.

15.   Limited Health Services: Our services are limited to compounded GLP-1 AGONIST weight management and related consultations. We do not provide emergency medical services. We do not manage or refill medications prescribed by non-Adiposity Clinic Clinicians or manage any other medical conditions not related to the symptomatic relief of side effects from prescribed compounded glp-1agonists by our clinicians. If you are experiencing an urgent medical issue, Dial 911 or reach out to your primary care physician for further instructions

16.   Telehealth and Medical Treatment Consents: By using our services, you consent to telehealth consultations and any medical treatments recommended by our clinicians. Separate TELEHEALTH Consent and MEDICAL CONSENT are available for viewing at https://www.AdiposityClinic.com

17.   Terms of Sale: Current pricing can be found on the website https://www.AdiposityClinic.com​. Payment for services is due at the time of purchase. Fees are subject to change with notice. Personal identifying information may be needed for billing purposes including name, addresses, Date of Birth, Credit Card numbers, phone and email addresses. You consent to permission of use to perform services you requested.

Credit card & Debit card processing through the PROGRAM occur through Stripe online processing application through the PORTAL.

18.   PaymentsAll sales are Final. You agree to pay all charges associated with our services in accordance with the payment terms specified. Upon utilizing our services you authorize THE ADIPOSITY CLINIC and its affiliates, our third party payment processors to charge the amount due.  Our payment system currently Stripe may retain your credit card information in all or part for future use by you in the encrypted system.

THE ADIPOSITY CLINIC cannot accept returns of prescription medications for reuse or resale. We do not issue refunds for unused medication if not tolerated or for other reasons. We do not replace medications that have been spilled, incorrect dosage used or not shipped to the correct location, stolen or never arrived. It is your responsibility to ensure that the medication will be sent to a safe location. We do not issue additional syringes or alcohol wipes if misused or run out. If there is an issue with medication including shipping, medication may be replaced on a case by case basis as determined by the Chief Medical Officer. Please email us at info@AdiposityClinic.com Unused portions of clinic monitoring are not refunded. Monitoring included only covers time frame of prescribed duration of medication.  If you do not tolerate medication, have blood work that is abnormal during the program causing you no longer to be able to continue with the program, or for any other reason, you will not be refunded for unused portion of PROGRAM monitoring.

19.   Cancellations & Refunds: Appointments must be cancelled 48 hours in advance to avoid charges for initial visit. Regular visits of current patients are free of charge up to 8 per year for clinician. Nurse visits are free of charge with varying amount as required by you for success of program. Program cancellation can be performed by not ordering any further monitoring & medication. If not an active patient for 60 days or more, you will need a new initial consult when you decide to return as a Patient. If you stop medication while you still have monitoring and medication left, please notify a nurse at info@AdiposityClinic.com It is important to understand why you are stopping as we may have a remedy to help with the issues you are having.

20.   Privacy: We respect your privacy and handle your personal information in accordance with our Privacy Policy, Notice of Practice Policy and applicable laws.

21.   Intellectual Property: All content and materials provided through our services are protected by intellectual property rights and are for non-commercial personal use only. No images, websites, materials may be distributed without permission.

22.   Third-Party Links and Websites: We are not responsible for the content or practices of third-party websites linked to or from our services.

23.   Disclaimer of Warranties: We do not warrant that our services will be error-free or uninterrupted. Use of our services is at your own risk. Services are provided on an “as available” basis without warranty of any kind. There is no guarantee for weight loss, or that the system, video, shipping or PROGRAM will function without delays, disruption or interferences.

24.   Limitation of Liabilities: The Adiposity Clinic shall not be liable for any indirect, incidental, special, or consequential damage, bodily damage, emotional stress, wrongful death, loss of profit arising out of or in connection with our services including use of our third-party associates. The scope of liability will be the minimum Permitted under applicable law with actual damages not to exceed U.S $1,000 after arbitration.

25.   Notice: All notices required or permitted under these terms shall be in writing and delivered to the address provided below.

26.   Indemnification: You agree to indemnify and hold harmless Tao Cosmetics pllc DBA The Adiposity Clinic, its employees Third party associates and suppliers from any claims arising out of your use of our services. We reserve the right to control the defense of any claim by a third party for which we are entitled indemnification, and you consent to provide us with such as is reasonably requested by us.

27.   Modifications to the Sites: We reserve the right to modify, suspend, or discontinue our services, or portions thereof, at any time with or without notice. You agree the Adiposity Clinic holds no liability for changes/ modifications to its sites, or for third Party modifications to their sites.

28.   Suspension & Termination of Rights: Terms remain in effect while using our sites and while an active Patient. We may suspend or terminate your access to our services if you violate these terms. If terminated THE ADIPOSITY CLINIC is not obligated to continue providing services, other than finish your prescribed course of treatment & maintaining your medical records for the specified period as required by law. 

The provisions listed below shall remain effective following the expiration or termination of these Terms, regardless of the reason: Disclaimer of Warranties; Limitation of Liability; Indemnification; Governing Law, Dispute Resolution, and Arbitration agreement.​​

29.   Governing Law, Dispute Resolution, Arbitration: These terms shall be governed by the laws of the State of Washington RCW 7.06​. Any disputes shall be resolved through binding arbitration in Snohomish County, WA in accordance with the rules of the American Arbitration Association.

In the event of a Dispute, we are committed to collaborating with you to achieve a reasonable resolution. Both parties agree that sincere efforts in good faith to resolve Disputes informally can lead to a swift, cost-effective, and mutually beneficial outcome. Therefore, before either party initiates arbitration against the other (or files an action in small claims court, if elected by a party), we will personally engage in a telephonic or videoconference meeting to discuss and attempt to resolve informally any Dispute covered by this Arbitration Agreement (“Informal Dispute Resolution Conference”). If you are represented by legal counsel, your counsel may participate in the conference, but your personal participation is also required.

Both You and We agree explicitly that any legal claim, dispute, or other controversy between you and us, or any of THE ADIPOSITY CLINIC including medical groups, providers, third party labs or pharmacies, arising from or related in any way to THE ADIPOSITY CLINIC parties, the Sites, the content, the service, or any other goods, services, or advertising provided by THE ADIPOSITY CLINIC or any associated entities (collectively, “Disputes”), including controversies regarding the applicability, enforceability, or validity of any provision of this agreement, shall be resolved through confidential binding arbitration. You and We Hereby waive any constitutional and statutory rights to sue in court and have a trial in front of a judge or a jury.This arbitration will be conducted before a single commercial arbitrator from the American Arbitration Association (“AAA”), rather than in a court, as outlined herein. The arbitration proceedings will adhere to the AAA’s Consumer Arbitration Rules and, if deemed applicable by the arbitrator, the Supplementary Procedures for Consumer-Related Disputes (collectively, “Rules and Procedures”).

You acknowledge that by agreeing to this arbitration provision, you are voluntarily waiving your individual or class action participation right to a trial by jury and to pursue claims in a lawsuit in state or federal court, except as expressly provided in this agreement. For the purposes of this arbitration agreement, “Dispute” will encompass disputes arising before the existence of these terms and conditions or any prior versions thereof, as well as claims that may arise after the termination of these terms and conditions.

The party starting a Dispute is required to inform the other party in writing about their intention to initiate an Informal Dispute Resolution Conference (“Notice”), which shall take place within 45 days after the other party receives it, unless both parties agree to an extension. Notice to us that you intend to initiate an Informal Dispute Resolution Conference should be sent by email to drdragotti@AdiposityClinic.com or by regular mail to: 3710 168th St NE, Suite B205, Arlington, WA 98223.

Detailed Reason for arbitration and expected resolution. We send arbitration notices to the address we have associated with your account.

Arbitration payment costs will be in accordance with the AAA’s Fee Schedule and paid by the party initiating the Arbitration. Each party agrees to pay its own attorney fees unless otherwise required by governing provision statues that require otherwise. Arbitrators’ award shall be binding.

in the event that there are more than 2 arbitrations for a similar nature sent to us by the same law firm or firms, or organizations within 30 days, the will be batched by the firm or organization with 1 arbitrator assigned with special master assistance per batch, and one resolution assigned for each consolidated batch. Filing & administrative fees to be paid by the initiator of the Arbitration.

YOU have the ability to opt of of the mandatory arbitration within 30 days from the date you first agree to any version of the arbitration by sending a request that includes: Your name, address, and email with a statement that you want to opt out of arbitration. Changes to the Arbitration agreement do not provide another opportunity to opt out if you have previously signed an earlier version and deadline has expired.

If any portion of this Arbitration is found to be unenforcible or invalid by law, that specific part will severed with the remaining arbitration portion agreement will remain in full effect.

Mandatory arbitration will remain in full effect after termination of your relationship with us by either You or We.

30.   Severability​ of Provision: If any provision of these terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

31.   Third-Party Beneficiaries: These terms do not create any third-party beneficiary rights.

32.   No Agency: Nothing in these terms shall be construed as creating an agency, employment, partnership, or joint venture between you and The Adiposity Clinic. You do not have the authority to enter into a contract on our behalf, or bind us in any way.

33.   Assignment: You may not assign or transfer your rights or obligations under these terms without our prior written consent.
